Evidence to keep

  • Transparency to deployersInstructions for use covering the Article 13 content
  • Transparency to deployersDeployer-facing documentation
  • Transparency to deployersEvidence the deployer received the current version

Questions before you sign

  • Does the instruction cover the oversight measures?
  • Does it state the limits and foreseeable misuse?
  • Is the deployer using the current version?

The requirement, in our words

High-risk systems must be sufficiently transparent for deployers to interpret the output and use it appropriately. The instructions must cover the intended purpose, accuracy, robustness, cybersecurity, foreseeable misuse, performance, oversight measures and the technical conditions of use.

What it means for human oversight

The instructions are the deployer's source for the oversight design. If they omit the limits or the oversight measures, the deployer cannot build a valid control from them.

How to evidence it

Attach the artefacts above to the Transparency to deployers row with the system name, the owner and the date. The first one is the anchor: Instructions for use covering the Article 13 content. The OH-41 file is complete when the named person can produce that artefact and explain the decision it records, without asking someone else where it is.

The reviewer will sample one live decision and ask for Deployer-facing documentation. If that artefact for OH-41 cannot be produced, the row is a gap, whatever the policy says.

OH-41 carries 3 evidence items and 2 common gaps. For transparency to deployers, keep the version the operator actually received with its date, because the current intranet copy is not evidence of what was in force. The OH-41 statement above is ours, written from EU AI Act, Article 13, not a reproduction of the licensed text.

Common gaps

  • Generic instructions without the required content
  • Instructions not updated with the system
Where the FDIS fits. The public abstract says the draft applies to all types of organizations across the AI system life cycle, so transparency to deployers is one of the places the guidance is expected to operate. For OH-41, the FDIS clause numbering and wording are not public, so this page cites EU AI Act, Article 13 above and does not quote the draft.
